Introduction
These Terms of Service (hereafter referred to as “Terms”) constitute a legally binding agreement between Toux Travel (referred to as “we”, “us”, “our”, or “the Agency”) and you (referred to as “you”, “your”, “the Client”, or “the Traveller”). They govern all bookings, purchases, and use of our services, including but not limited to holiday packages, tours, accommodation bookings, transport arrangements, transfers, activities, and travel consultancy services.
By making a booking, paying a deposit or full amount, or using any service provided by us, you confirm that you have read, understood, and agreed to be bound by these Terms, together with our Refund Policy, Privacy Policy, and any other specific conditions mentioned at the time of booking.
If you do not agree with any part of these Terms, you must not proceed with your booking or use our services.
1. Role of the Agency
1.1 Nature of Services: Toux Travel acts as a travel agency and intermediary. We design, arrange, and sell travel packages and services supplied by third‑party providers, including airlines, hotels, resorts, transport companies, ferry operators, activity providers, tour guides, and other independent suppliers. In some cases, we may operate our own tours or services; in such cases, we will be clearly identified as the service provider.
1.2 Contractual Relationship: When you book a service or package through us, you enter into separate contracts with:
- Toux Travel (for the arrangement, planning, and reservation services), and
- The relevant third‑party supplier (for the actual provision of accommodation, transport, activities, or other services).
1.3 Limitation of Responsibility: We are not the owner, operator, or manager of hotels, transport vehicles, or facilities included in your travel arrangements. We do not own, control, or manage these third‑party services, and we cannot be held liable for any acts, omissions, errors, or negligence of these independent suppliers. Our responsibility is limited to the careful selection of reputable suppliers and the accurate communication of information provided to us by them.
2. Bookings and Confirmation
2.1 Booking Process: All bookings are subject to availability. You may make a reservation via our website, email, telephone, or in‑person consultation. To confirm a booking, you must provide accurate, complete, and up‑to‑date information for all travellers, including full names (as shown in official identification documents), dates of birth, contact details, and any special requirements.
2.2 Confirmation: A booking is only considered confirmed once:
- We have issued a written confirmation (by email or document), and
- We have received the required deposit or full payment, as applicable.
No verbal agreement or informal reservation shall be binding until confirmed in writing by us.
2.3 Accuracy of Information: You are solely responsible for the accuracy of all information provided to us. We cannot be held liable for problems, additional costs, or cancellations arising from incorrect names, wrong dates, or missing information provided by you. Corrections requested after confirmation may incur administrative fees or supplier charges.
2.4 Minimum and Maximum Numbers: Some tours, packages, or services require a minimum number of participants to operate. If the minimum number is not reached, we reserve the right to cancel the booking up to 15 days before departure, offering a full refund or an alternative itinerary. We may also limit the maximum number of participants per booking or tour.
3. Payments and Pricing
3.1 Prices: All prices quoted are in Euro (€), unless otherwise stated. Prices include only the services explicitly listed in the itinerary or quotation. They do not include personal expenses, additional services, optional activities, travel insurance, visas, tips, or any items marked as “extra” or “not included”.
3.2 Price Changes: Prices are calculated based on costs, taxes, exchange rates, and supplier tariffs at the time of quotation. We reserve the right to modify prices before confirmation due to changes in taxes, fuel surcharges, transport costs, or regulatory fees. Once your booking is confirmed and deposit is paid, prices will not be changed unless required by law or government regulation.
3.3 Payment Schedule:
- Deposit: A non‑refundable deposit of 30% to 50% of the total price is required at the time of booking to secure your place.
- Final Payment: The remaining balance must be paid no later than 30 days before the departure date.
- For bookings made less than 30 days before departure, full payment is required immediately.
3.4 Failure to Pay: If you do not pay the balance by the due date, we reserve the right to treat your booking as cancelled by you, and our standard cancellation and refund terms (as outlined in our Refund Policy) will apply.
3.5 Payment Methods: We accept payments via bank transfer, credit/debit card, or other methods indicated on our invoice. All transaction fees, bank charges, or currency conversion costs are your responsibility.
4. Cancellations, Refunds and Modifications
4.1 Cancellation by You: If you wish to cancel your booking, you must notify us in writing. Cancellations are effective only from the moment we receive your notice. Refund amounts and cancellation fees are strictly governed by our Refund Policy, which forms part of these Terms.
4.2 Changes and Modifications: Any request to change dates, destinations, travellers’ names, or services will be treated as a cancellation and re‑booking. Standard cancellation fees, plus any additional costs from suppliers, will apply. Changes requested less than 15 days before departure may not be possible.
4.3 Cancellation or Changes by Us: We reserve the right to cancel or modify arrangements if:
- Payment is not made on time;
- Information provided is false or incomplete;
- Minimum group sizes are not met;
- Changes are required by suppliers or for safety, legal, or operational reasons.
In such cases, we will offer you either an equivalent alternative or a full refund of amounts paid. We are not liable for additional expenses or indirect damages.
4.4 Supplier Changes: Third‑party suppliers may occasionally modify or cancel services due to maintenance, weather, operational needs, or other reasons. We will inform you as soon as possible and assist in finding solutions or obtaining refunds according to the supplier’s own policies.
5. Client Responsibilities
5.1 Documentation: You are solely responsible for obtaining all necessary travel documents, including valid passports, visas, health certificates, vaccination records, travel insurance, and any other documents required by the countries you visit. We provide general guidance but do not issue visas or guarantee entry permissions. You must ensure your passport is valid for at least 6 months beyond your travel dates.
5.2 Compliance with Laws: You agree to comply with all laws, regulations, customs rules, and health requirements of the countries visited. You are responsible for any fines, penalties, or costs resulting from non‑compliance.
5.3 Behaviour: You agree to behave respectfully towards other travellers, our staff, suppliers, and local communities. We reserve the right to terminate your travel arrangements immediately and without refund if your behaviour is considered dangerous, offensive, disruptive, or illegal. You will be liable for any damage or loss caused by you.
5.4 Health and Fitness: You confirm that you and all members of your group are in good physical and mental health suitable for the travel planned. You must inform us in writing of any medical conditions, allergies, or special needs at the time of booking, so we can assess feasibility. We are not responsible for any medical care, evacuation, or costs related to health issues during travel.
5.5 Special Requests: Any special requests (e.g. dietary needs, room location, bed type) are subject to supplier availability. We will make reasonable efforts to fulfil them, but we do not guarantee they will be met. Unfulfilled special requests are not grounds for cancellation or refund.
6. Liability and Limitations
6.1 General Liability: We exercise reasonable care and skill in selecting suppliers and organising travel arrangements. However, our total liability to you under any claim — whether in contract, negligence, or otherwise — is limited to the total amount paid by you to us for the services in question.
6.2 Exclusions: We are not liable for:
- Loss, damage, or theft of personal belongings, luggage, or valuables;
- Injury, illness, death, or accidents occurring during travel or while using third‑party services;
- Delays, cancellations, schedule changes, or missed connections caused by transport companies, weather, strikes, or operational issues;
- Changes, errors, or omissions in services provided by third‑party suppliers;
- Additional expenses, such as accommodation or meals, incurred due to delays or changes;
- Events classified as Force Majeure (see Section 7).
6.3 Local Laws and Limitations: Some countries or suppliers may have laws that limit or exclude liability. Where applicable, those local terms shall apply. Nothing in these Terms shall exclude or limit liability that cannot be excluded by law.
7. Force Majeure
We are not responsible for any failure, delay, or alteration of services caused by events beyond our reasonable control, including but not limited to:
- Natural disasters, earthquakes, storms, floods, or extreme weather;
- War, terrorism, civil unrest, riots, or political instability;
- Government orders, travel bans, border closures, or legal restrictions;
- Pandemics, epidemics, health alerts, or quarantine measures;
- Strikes, labour disputes, or industrial action;
- Failures of transport, infrastructure, or communication networks.
In such situations, our obligation is limited to assisting you in recovering refunds or credits from suppliers. We will issue refunds only to the extent that we ourselves receive payments or refunds from our service providers. We strongly recommend you purchase travel insurance covering these circumstances.
8. Intellectual Property
All content on our website, brochures, itineraries, and documents — including text, images, logos, designs, descriptions, and pricing — is the intellectual property of Toux Travel. You may not reproduce, distribute, modify, or use any of our materials without our prior written consent.
Photos and descriptions of hotels, destinations, or activities are provided by suppliers; actual conditions may vary slightly.
9. Travel Insurance
We strongly and expressly recommend that all clients purchase comprehensive travel insurance at the time of booking. Your policy should cover cancellation costs, medical expenses, emergency repatriation, loss or damage to luggage, personal liability, and other unforeseen events. If you cannot travel due to circumstances covered by insurance, you must claim directly from your insurer, not from us.
10. Privacy and Data Protection
We collect and process personal data in accordance with our Privacy Policy and applicable Spanish and European data protection laws (GDPR). By booking with us, you consent to the processing and transfer of your data to third‑party suppliers and authorities as necessary to provide services. We will never sell or misuse your personal information.
11. Complaints and Disputes
11.1 During Travel: If you experience a problem or have a complaint during your trip, you must inform our local representative or contact us immediately, so we have the opportunity to resolve the issue while you are travelling. Failure to report problems on‑site may affect your ability to claim later.
11.2 After Travel: Any complaint or claim must be sent to us in writing within 14 days of the end of your trip. We will investigate and respond within 30 working days.
11.3 Governing Law and Jurisdiction: These Terms and any disputes arising from them shall be governed by the laws of Spain. Any legal action shall be brought exclusively before the courts of Madrid, Spain.
12. Changes to Terms
We reserve the right to update or modify these Terms at any time. Changes will be published on our website and will apply to all bookings made after the date of publication. The version applicable to your booking is the one in force at the time you confirm your reservation.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
